By accessing or using the Tuarus Container Service website and purchasing our products, you agree to be bound by these Terms of Service. Please read them carefully.
1. Acceptance of Terms
Welcome to Tuarus Container Service ("Company," "we," "us," "our"). These Terms of Service ("Terms") govern your access to and use of our website https://tuaruscontainerservice.com (the "Site") and any purchase of products or services from us.
By accessing our Site, placing an order, or otherwise engaging with our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not use our Site or purchase our products.

Under the Connecticut Uniform Electronic Transactions Act (UETA) — Connecticut General Statutes § 1-266 et seq. — your electronic acceptance of these Terms (by clicking "I Agree," placing an order, or using our Site) constitutes a legally binding agreement with the same force and effect as a physical signature.
2. Eligibility
By using our Site and purchasing our products, you represent and warrant that:
- You are at least 18 years of age and have the legal capacity to enter into a binding contract.
- You are a resident of the United States or Canada (international shipping available on a case-by-case basis).
- All information you provide to us is accurate, current, and complete.
- You will not use our Site or products for any illegal or unauthorized purpose.
- Your use of our Site does not violate any applicable laws or regulations, including Connecticut General Statutes.
3. Products & Pricing
Product Descriptions: We strive to display accurate descriptions, specifications, and images of our shipping containers. However, we do not warrant that product descriptions, colors, or other content are error-free. Container conditions (e.g., cargo-worthy, wind & watertight, as-is) are described in good faith based on industry standards.
Pricing: All prices are listed in United States Dollars (USD) and are subject to change without notice. We reserve the right to modify or discontinue any product at any time. In the event of a pricing error on our Site, we reserve the right to cancel any orders placed at the incorrect price.
Quotes: Quotes provided by our sales team are valid for 14 days from the date of issuance unless otherwise stated. Quotes are not binding until accepted and payment is received.
⚠️ Connecticut Consumer Protection Notice
Under the Connecticut Unfair Trade Practices Act (CUPTA) — Connecticut General Statutes § 42-110a et seq. — we are prohibited from engaging in deceptive or unfair trade practices. All pricing and product descriptions are provided in good faith. If you believe you have been misled, please contact us immediately.
4. Orders & Payment
Order Acceptance: Your receipt of an order confirmation email does not constitute our acceptance of your order. We reserve the right to refuse or cancel any order for any reason, including product availability, pricing errors, suspected fraud, or violation of these Terms.
Payment Terms: Full payment is required before your container is dispatched. We accept Credit Cards (Visa, MasterCard, American Express, Discover) and Bank Transfers (ACH/Wire). Your order will be processed only after funds have fully cleared in our accounts (see our Payment Policy for details).
Financing: If you choose our lease-to-own or financing options, additional terms and credit checks may apply. Financing is provided by third-party partners; we are not responsible for their approval decisions or terms.
5. Shipping & Delivery
Shipping and delivery are governed by our Shipping Policy. Key terms include:
- $450 flat rate shipping for standard delivery within the contiguous United States.
- 5-7 day delivery guarantee from payment clearance (subject to site accessibility).
- You are responsible for preparing your delivery site according to our requirements.
- Failed delivery attempts due to inaccessible or unprepared sites will incur additional fees.
- Title and risk of loss pass to you upon delivery and your signature on the Bill of Lading.
6. Inspection & Acceptance
Upon delivery, you have the right to inspect the container before signing the delivery receipt. Under Connecticut General Statutes § 42a-2-513, your signature constitutes acceptance of the container in its delivered condition unless you note damage on the delivery receipt.
Concealed Damage: If you discover damage after delivery that was not visible at the time of drop-off, you must notify us within 48 hours with photographic evidence. We will assist in filing a claim with the carrier.
⚠️ IMPORTANT: Inspection Required
Failure to inspect your container at delivery and note any damage on the Bill of Lading may waive your right to claim damages from the carrier. Always inspect before signing.
7. Warranties & Disclaimers
Limited Warranty: Tuarus Container Service provides a limited structural warranty on containers based on their condition grade (see our Warranty Policy for details). New/one-trip containers have a 10-year warranty; cargo-worthy containers have a 5-year warranty; WWT containers have a 2-year warranty; as-is containers have no warranty.
Disclaimer of Implied Warranties: TO THE FULLEST EXTENT PERMITTED BY LAW, EXCEPT FOR THE EXPRESS LIMITED WARRANTY PROVIDED ABOVE, TUARUS CONTAINER SERVICE DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
Connecticut Limitation: Some states, including Connecticut, do not allow limitations on how long an implied warranty lasts. In such jurisdictions, the limitations above may not apply to you to the extent prohibited by law. This warranty gives you specific legal rights, and you may have other rights that vary by state.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TUARUS CONTAINER SERVICE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF USE, OR LOSS OF DATA, ARISING OUT OF OR RELATING TO YOUR USE OF OUR SITE OR PURCHASE OF OUR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR PURCHASE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID FOR THE SPECIFIC CONTAINER GIVING RISE TO THE CLAIM.
📋 Connecticut Legal Notice
Certain Connecticut laws may not allow the exclusion or limitation of certain damages. In such cases, our liability shall be limited to the fullest extent permitted by Connecticut General Statutes and applicable federal law.
9. Returns & Refunds
Returns are subject to our Return Policy (available upon request). Key terms include:
- Cancellations within 24 hours of payment receive a full refund.
- Cancellations after 24 hours but before shipment incur a 15% restocking fee.
- Return shipping costs are the responsibility of the buyer unless the return is due to our error.
- Custom-modified containers are non-returnable and non-refundable.
- Refunds are processed within 5-7 business days to the original payment method.
10. Intellectual Property
All content on our Site, including text, graphics, logos, images, software, and trademarks, is the property of Tuarus Container Service or its licensors and is protected by United States and international copyright, trademark, and intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content from our Site without our express written consent. "Tuarus Container Service" and our logo are registered trademarks.
11. Prohibited Conduct
You agree not to:
- Use our Site for any illegal purpose or in violation of any applicable law.
- Attempt to interfere with the security or functionality of our Site.
- Scrape, crawl, or use automated means to access our Site without permission.
- Impersonate another person or entity or provide false information.
- Resell containers purchased from us without our prior written authorization.
- Use our containers for illegal activities, including unauthorized storage of hazardous materials.
12. Indemnification
You agree to indemnify, defend, and hold harmless Tuarus Container Service, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
- Your use of our Site or products.
- Your violation of these Terms.
- Your violation of any applicable law or third-party rights.
- Any content you submit to our Site.
13. Third-Party Links
Our Site may contain links to third-party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites. You acknowledge and agree that we shall not be liable for any damages or losses caused by your use of such third-party sites.
14. Force Majeure
We shall not be liable for any delay or failure to perform our obligations under these Terms if such delay or failure results from events beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, labor strikes, supply chain disruptions, government actions, pandemics, or severe weather conditions.
15. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Connecticut, without regard to its conflict of law principles. The Connecticut Uniform Electronic Transactions Act (UETA) and Connecticut General Statutes shall apply to all electronic transactions.
Any legal action or proceeding arising out of or relating to these Terms or your use of our Site shall be brought exclusively in the state or federal courts located in Stamford, Connecticut. You consent to the personal jurisdiction of such courts and waive any objection based on improper venue or forum non conveniens.
⚖️ Connecticut Dispute Resolution
Before initiating any legal proceeding, you agree to first contact us to resolve any dispute informally. If the dispute cannot be resolved within 30 days, either party may initiate mediation or binding arbitration in accordance with Connecticut General Statutes § 52-408. Small claims court actions in Stamford, Connecticut are permitted.
16. Class Action Waiver
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AGREE TO BRING ANY CLAIM AGAINST TUARUS CONTAINER SERVICE ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. YOU WAIVE THE RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
17. Modifications to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms on our Site and updating the "Last Updated" date. Your continued use of our Site or purchase of our products after such changes constitutes your acceptance of the modified Terms.
18. Severability
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
19. Entire Agreement
These Terms, together with our Privacy Policy, Shipping Policy, Payment Policy, Warranty Policy, and Sales Tax Policy, constitute the entire agreement between you and Tuarus Container Service regarding your use of our Site and purchase of our products. Any prior agreements, representations, or understandings, whether written or oral, are superseded by these Terms.
